The Policy defines “property damage” as “physical damage to or destruction of tangible property, including loss of use of this property.”

Your request for State Farm to cover the lien is a request by you to cover your economic losses, not a claim by third-party for “property damages.” As such, there is no coverage for the lien under the State Farm Policy, which limits liability coverage to “bodily injury” or “property damages.” Accordingly, State Farm disclaims any obligation to pay for the lien on your Unit.

State Farm expressly reserves all rights under the Policy, and available at law, to disclaim coverage on additional or alternative bases if other terms, conditions, exclusions, endorsements, and provisions of the Policy are found to be applicable.

State Farm’s position is based on the information known at this time and the terms and provisions of the Policy. This letter is not intended to be, nor is it to be construed as, an exhaustive listing of all the terms, conditions, limitations and exclusions of the Policy, which might limit or preclude coverage for this matter. If you have any additional information that you believe is pertinent to the coverage issues raised under the Policy, State Farm asks that you provide this information as soon as possible to allow us to reevaluate coverage.

No action undertaken by State Farm in investigating the facts in connection with this claim shall be construed in any way as waiving any right or operating an estoppel to assert any right which State Farm has under the law or policy at issue, nor shall any such action be deemed in any way to be an admission of liability or an admission of coverage under the Policy.
