Remember pending cases are those that have

gone pretty far in the process. The adjudication is pretty much done, NC cleared. All they need is an available visa number. These are cases affected by earlier retrogressions. They're really the low hanging fruit for CIS.

For cases that recently got filed, I'm not sure whether they've also got visa number pre-allocation. I doubt.
