请教八老师，EB2 I-140 已经获批。现要转EB3。从priority date开始算，公司2020年亏损，我的工资达不到最低工资要求。2021，2022年盈利，同时现在我的工资已经超过要求的最低工资。EB3 的I-140如何办？律师说需要写一封说明信来解释原因。

-USCIS recently changed the rule which is more favorable to the employer and the beneficiary. Based on the new rule,  USCIS do not require that the employer has to demonstrate the ability to pay from the date the employer files PERM until the beneficiary files I-485, but the employer only needs to demonstate the ability to pay when the beneficiary files I-485. So, I think the explanation should be OK.

如果解释不被接受，会不会影响已经批准的EB2 的I-40？
