Of course, you can send the request to USCIS for the upgrading now by providing the copy of I-130 Receipt Notice, but USCIS will not forward your case to NVC until I-130 is approved. Also, your son had better not get married again after you request I-130 is upgrading, otherwise, you need to request downgrading again.
