有一个朋友目前是R1签证，一年后可以申请I-360. 目前这个类别出现了几年的排期，而R1只能工作5年。这种情况下，R1任期结束前排期还没有到，I-360通过而不能递交I-485，该怎么办？

-Try to find anther job such as in a non-profit institution and then, change R-1 to  H-1.

是不是只能回国，而I-360申请将变成无效？

-The I-360 is always valid unless the employer withdraw it. So, if your friend has to return to China, he/she can apply for the immigrant visa in the US Consulate in Guangzhou when the I-360 prority date is current to return to US to become a green card holder.
