车祸赔偿请教

对方全责，纽约州 （no-fault state），报自己保险公司因为受伤，total loss,  自己保险公司给出的车赔偿额减去了 Extra Towing and Storage Fees, 沟通了几次，也没有得到 waiver,给出的理由是 policy $1000 Max, 超出的需要自己承担. 对方保险公司也不爱搭理因为我告诉他们走律师起诉. 请问这个费用怎么要回来？估计最后的赔偿会要价几十万，这个小数是不说是就被淹没了。
