首先,想强调一下,这个ticket 上写的只是loitering, 没有其它, 罚单照片见下,罚款是250 加币
另外,peace officer 不是 police, 我虽然移民来加拿大很多年,在此事发生之前,完全不知道peace officer 是干什么的,有什么权利。
我打算自辩时做以下陈述:
1, 我是移民,英语不是我的母语,我对loiter 和loitering 的理解只能来自有名的英语字典和维基百科,New Oxford America Dictionary 和Oxford Language 对loiter 的解释是 stand or wait around idly or without apparent purpose. 维基百科对loitering 的解释是,Loitering is the act of standing or waiting around idly without purpose in some public places.
I am an immigrant, English is not my native language. My understanding of loiter and loitering can only come from famous English dictionaries and Wikipedia. The New Oxford America Dictionary and Oxford Language explain loiter as stand or wait around idly or without apparent purpose. Wikipedia explains loitering as, Loitering is the act of standing or waiting around idly without purpose in some public places.
2, 在罚单上所引用的市政交通附例中,没有对loiter 和loitering 有特殊的定义,故我认为字典和维基百科对loiter 和loitering 的定义适用于罚单所引用的市政交通附例。在市政交通附例中,只有条文明确写着没有人可以在公交车上或公交所属地loiter. 没有写在你想乘坐的公交车到来时,你必须马上乘坐你想要乘坐的公交车,这就是说,如果一个人计划要搭公交但在候车厅里错过几趟他/她想乘搭的车并没有违反市政交通附例关于对loitering 的规定

In the Municipal Transportation Bylaw, there is only a clause that clearly states that No person shall loiter on any transit vehicle or transit property.
