这个方法听起来我们可以尽力去试一下。 孩子和他的生父母以前从没来过美国， 也从没有去办理任何签证来美国。 

孩子因为家庭的变故， 现在他很可怜。 

1. 现在国内已经开学了。错过了今年暑假，等到明年夏天让他去签B2 visa 可以吗？ 还是最好尽快去签？ 

-Had better do it in the next Summer time. 

   我和LG2月明年2 月都会回国一趟， 那时候带他一起去签过B2 visa 的概率不知道会不会大些？

-It is dificult to convinec the visa officer that the kid just wants to visit you, and does not have immigrant intent if he applies for the visa not in Summer vacation time.

   有什么准备手续最好在明年2 月我们都回国的时候就办理吗？

  因为他现在12 岁 2 个月了。 比较担心那个领养14岁（还是16 岁?) 的限制。

2. 他拿B2 Visa 可以在美国公立学校上学吗？ 

-Technically, no. But some Public school may not care about it and USCIS is not very strict for the minor kid to attend the public school with B2 status.

3. 如果没有拿到B2 Visa extension， 甚至overstaying， 他还可能在公立学校接着上学吗？

-The school may not care about it.

4. 我在什么时候开始办Family based petition adoption 美国这边需要提交的收养文件，还有国内需要的收养文件？
    有时间先后要求吗？ 

-The biological parents may need to write a statement (notarize it) to abandon the custody of the child and then, you need to go to the local court in US to apply for the  custody of the child and complete the adoption process there. Once you get the approval of  custody of the child and adoption from the local US court, you can add the child to your household members such as for health insurance, tax bebefits, etc. You can use this kind of evidences for the child immigration application after two years later.
